Terms of Service ​

These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and related services provided by Unsent (“Unsent,” “we,” “us,” or “our”), operated by DFANS INC (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility ​

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration ​

You may need an account to access certain features. You agree to:

  • Provide accurate and complete registration information
  • Keep your credentials confidential and secure
  • Promptly update information if it changes
  • Accept responsibility for activity under your account

Notify us immediately if you suspect unauthorized access to your account. We may suspend or terminate accounts that violate these Terms or present a security risk.

3. The Services ​

Unsent provides tools for creating, storing, and managing written content that may remain private or be sent at your direction. Features may change over time. We may add, modify, or discontinue parts of the Services with or without notice, subject to applicable law.

We do not guarantee uninterrupted or error-free operation of the Services.

4. Your Content ​

4.1 Ownership ​

You retain ownership of the content you create or upload to the Services (“Your Content”).

4.2 License to Unsent ​

You grant Unsent a limited, worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely as needed to operate and provide the Services and as otherwise directed by you (for example, when you choose to send or export content).

4.3 Responsibility for Your Content ​

You are solely responsible for Your Content and for ensuring you have all rights necessary to provide it. You represent that Your Content and your use of the Services will not:

  • Infringe intellectual property, privacy, publicity, or other rights of others
  • Violate any law or regulation
  • Contain malware or harmful code
  • Harass, threaten, defame, or exploit others
  • Involve unauthorized access to systems or data

We may remove or restrict Content that violates these Terms or that we reasonably believe is unlawful or harmful.

5. Acceptable Use ​

You agree not to:

  • Misuse the Services or interfere with their normal operation
  • Attempt to probe, scan, or test the vulnerability of any system without authorization
  • Reverse engineer, decompile, or circumvent security or access controls, except where prohibited by law from restricting such activity
  • Use the Services to send spam, phishing, or deceptive communications
  • Impersonate another person or misrepresent your affiliation
  • Scrape or harvest data from the Services except through documented public interfaces and with permission
  • Use the Services for any unlawful purpose

6. Privacy ​

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that Privacy Policy.

7. Intellectual Property ​

The Services, including software, design, branding, and documentation (excluding Your Content), are owned by Unsent or its licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without prior written permission.

8. Third-Party Services ​

The Services may integrate with or link to third-party products. Your use of those products is subject to their terms and privacy policies. Unsent is not responsible for third-party services.

9. Disclaimers ​

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNSENT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will meet your requirements, be uninterrupted, secure, or error-free, or that content will be preserved without loss. You are responsible for maintaining your own backups of important content where appropriate.

10. Limitation of Liability ​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNSENT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO UNSENT FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

11. Indemnification ​

You agree to indemnify and hold harmless Unsent and its affiliates, officers, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to Your Content, your use of the Services, or your violation of these Terms or applicable law.

12. Termination ​

You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or if we discontinue the Services.

Upon termination, your right to use the Services ends. Provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnification) will survive termination.

13. Changes to the Terms ​

We may update these Terms from time to time. We will post the updated Terms and revise the “Last updated” date. If changes are material, we may provide additional notice. Continued use of the Services after the updated Terms take effect constitutes acceptance of the changes.

14. Governing Law ​

These Terms are governed by the laws applicable in the jurisdiction where Unsent principally operates, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

15. General ​

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Unsent regarding the Services.
